Dr. Abere provides economic research, data analysis, and expert witness testimony in cases involving antitrust, contracts, intellectual property, and other commercial litigation as well as regulatory proceedings.

Dr. Abere has more than twenty-five years of experience providing economic research, data analysis, and expert witness testimony in cases involving antitrust, contracts, intellectual property, and other types of commercial litigation as well as in regulatory proceedings. He has served as a consultant and expert witness on issues of liability, class certification, and damages in cases in U.S. State and Federal courts, including as a court-appointed expert witness in U.S. Federal court. He has also appeared before the U.S. Federal Trade Commission, the U.S. Department of Justice, the Italian Antitrust Authority, and the French Competition Council.

Dr. Abere’s experience in antitrust and competition cases includes matters involving mergers and acquisitions; price-fixing and collusion; price discrimination; and monopolization and vertical restraints. Dr. Abere’s experience in contract cases includes the economic analysis of contract terms, such as most favored nation clauses, as well as the measurement of damages for breach of contract, including lost profits and disgorgement.

Dr. Abere’s experience spans a wide range of industries, including (with selected clients): pharmaceuticals (GlaxoSmithKline, Amgen); consumer products (the Coca-Cola Company, Philip Morris USA, Miller Brewing); sports (NASCAR, the National Football League); entertainment (Comcast, Bertelsmann Music Group); transportation (Avis Budget Group, US Airways); retailing (Dollar Tree, Albertson’s); financial services (Visa, MasterCard); and chemicals (BASF, DuPont, PPG). Dr. Abere has also provided consulting services to the U.S. Federal Trade Commission, the U.S. Department of Justice, and the Canadian Competition Bureau.

Prior to joining Brattle, Dr. Abere was a Senior Economist at Princeton Economics Group, a Senior Manager at Ernst & Young LLP, and an Economist at Skadden, Arps, Slate, Meagher & Flom LLP. In addition to consulting, Dr. Abere has also held positions at Columbia University, New York University, and Rutgers University, where he has taught courses in industrial organization, microeconomic theory, and the economic analysis of law.

Brattle principal Dr. Andrew Abere contributed to an amicus curiae brief submitted by the Patents and Antitrust Committees of the New York City Bar Association (NYCBA) in a case currently before Supreme Court that proposes that the Court overrule its 1964 decision in Brulotte v. Thys Co. in which it held that a royalty agreement that extends beyond the expiration of the patent term is unlawful per se.

Andrew Abere and Lisa Cameron have been selected to present at an upcoming meeting of the New York State Bar Association’s Antitrust Section Executive Committee and the New York City Bar Association’s Antitrust and Trade Regulation Committee. The event will take place on October 15, 2014 at Shearman & Sterling LLP in New York, NY.

Personal Interests

Andy and his wife Lisa live in central New Jersey with their son Spencer and their daughter Amanda. As the parent of a child with autism, Andy has been very active in the autism community.

Andy has served as Chairman of the Board of Spectrum Works, on the Board of Trustees of Eden Autism Services, on the Advisory Board of Autism Family Services of New Jersey and as a volunteer with Special Olympics New Jersey in its cycling competition. He has also served as a presenter at Autism NJ’s annual conference on the topic of evaluating research related to autism.

In addition, he served as one of a select number of public reviewers for the National Institute of Mental Health in evaluating applications for funding for research on autism available under the Obama administration’s stimulus package. Andy founded the Ride for Autism, the nation’s first charity bicycle tour to support individuals with autism and their families.
