Mr. Harris has more than fifteen years of experience as expert in valuation, quantification of damages, and the economics of gas and electricity markets.

He has been retained by major law firms and their clients to testify on damages and quantum in international arbitration proceedings in a variety of forums. He also provides advice in gas contract disputes during both the negotiation and arbitration phases and has working experience of the upstream oil and gas sector. Mr. Harris has been recognized as one of the world’s leading arbitration experts in Global Arbitration Review’s Who’s Who Legal: Arbitration 2018.

In electricity and gas matters, Mr. Harris has been engaged by energy regulators, competition authorities, gas and electricity network companies, gas buyers and sellers, and electricity generators. His regulatory experience includes work on the design of gas and electricity trading arrangements, a design for a traded gas market in Colombia, and the development of a capacity market mechanism for the Italian electricity market, as well as high-profile work on the development of new European network codes for ACER, the EU energy regulator.

Mr. Harris has consulted on developing tariffs and access arrangements for gas and electricity networks and has authored reports on the cost of capital for gas, electricity, water distribution, and telecommunications networks.

Mr. Harris is a regular speaker at conferences, and lectures at the Florence School of Regulation. Prior to joining The Brattle Group in 2002, he worked for Shell for five years in a variety of roles.

Representative Engagements
Expert testimony in a power plant construction dispute
Mr. Harris acted as an expert witness in an ICC dispute involving a large power and water production plant in the Middle East. The work involved testimony on the financial effects of various delays which the project experienced, including a quantification of the effect of an alleged delay in refinancing on the value of the project. Mr. Harris also analysed the reasonableness of a claim by the offtaker that the plant’s tariff should be reduced because of alleged non-conformity with the contract specifications. The case involved written and oral testimony. The claims and counter claims were in the order of US$200-300 million.
Expert testimony in a gas contract dispute
In an arbitration before the ICC concerning the value of gas under a long-term gas sales agreement, Mr. Harris was retained by a buyer of gas in southeast Europe to give both written and oral evidence on the appropriate adjustment to the gas price formula, as well as the damages arising from an alleged failure of the seller to supply gas to the buyer. The amounts in dispute were in the order of US$200-300 million.
Expert testimony in an investor-state international arbitration
An investor, in a dispute before the Permanent Court of Arbitration with a State in south-east Europe, retained Mr. Harris to act as an expert. Mr. Harris prepared evidence on the damages suffered by the investor as a result of the alleged failure to return processed of copper concentrate and to repay of loans. The case involved an assessment of bankruptcies claims and the relevant firms’ ability to repay amounts at different points in time. The amounts claimed were in the order of US$100 million.
