The Brattle Group provides expert testimony before regulatory commissions, courts, and arbitration and mediation panels regarding prudence, antitrust, and damages in energy contract litigation as well as on aspects central to liability claims.

Our work draws on the in-depth experience of nationally and internationally recognized experts in industry structure and operations. We testify on electricity, natural gas, coal, and oil industry fundamentals, common use of industry terms, industry practices, the materiality of misrepresentations in securities offerings, and whether reasonable efforts were undertaken to mitigate damages.

We assist clients with the development of economic arguments, class certification issues, litigation risk analysis, and with discovery, depositions, and cross examination. We help clients identify and coordinate expert witnesses and in drafting legal documents involving economic subject areas or highly technical industry matters. We assess technical issues, participate in settlement negotiations, and help allocate damages awards or settlements among multiple claimants. The Brattle Group also provides energy economic consulting services to clients in contract (re)negotiation, formulation and review of procurement strategies and auctions, and the valuation of contracts and specific contract terms.
