Mike Cragg and Evan Cohen to Discuss the Use of Testifying Experts at the ABA Tax Section Fall Meeting

Brattle principals Mike Cragg and Evan Cohen have been selected to serve as panelists at the American Bar Association Tax Section’s fall meeting, where they will present their spotlight discussion “Experts in the Trenches: Risk, Fair Rewards, Economic Substance, and Shams.” The event will take place September 18-20, 2014 in Denver, Colorado.

Dr. Cragg and Mr. Cohen will present alongside Iriving Plotkin, a senior managing director of tax controversy at PricewaterhouseCoopers. The panel will address the challenges and practices of expert presentation and the scope of economic analysis relevant to the measurement of risk, determination of fair rewards to capital, issues of economic substance, and whether a transaction is a “sham.”

All three panelists are experts in this area and have recently testified about these issues at trial, collaborated with attorneys on all aspects of related case management and strategy, and worked with the Organization for Economic Co-operation and Development (OECD) on Base Erosion Profit Shifting (BEPS) issues.
