Pallavi Seth to Present on Intellectual Property and the ITC at the ABA Annual Meeting

Brattle senior associate Pallavi Seth will present on International Trade Commission (ITC) Section 337 intellectual property claims at the American Bar Association’s (ABA) Annual Meeting, taking place July 30-August 4, 2015 in Chicago, IL.

Dr. Seth will participate in the panel discussion, “Section 337 at the U.S. International Trade Commission: Patents and Beyond,” discussing the increasing frequency of Section 337 investigations at the ITC involving infringement of design patents, misappropriation of trade secrets, trademark/trade dress infringement, copyright/DMCA violations, and antitrust violations. This trend can be attributed to the globalization of business, and subsequent theft and unauthorized use of various forms of intellectual property, resulting in loss of competitive edge and market share.

Dr. Seth and her co-panelists will discuss how the ITC has seen a recent influx of intellectual property claims beyond the usual utility patent infringement, and how the venue might continue to transform following pending Federal Circuit decisions. The panel will also address important procedures, characteristics, remedies, and requirements in infringement cases when using the ITC as a potential venue. Dr. Seth will place particular emphases on domestic industry requirements and proper determination of injury in trade secret cases at the ITC.
