Brattle Consultants Evaluate Oxera Report on Quantification of Antitrust Damages in Journal of European Competition Law & Practice

Brattle principals Carlos Lapuerta and Dan Harris and senior associate Richard Caldwell have authored an article in the October 2010 issue of the Journal of European Competition Law & Practice (JECLAP). The article, “Towards Non-binding Guidance for Courts: The Oxera Report and the Quantification of Antitrust Damages,” reviews the benefits and drawbacks of a report prepared by Oxera for the European Commission on alternative methodologies for quantifying antitrust damages. The authors highlight key contributions of the report, including its provision of useful background and specific damages analysis methodologies for court reference. However, the authors argue that one limitation of this report is that it fails to question whether previous court judgments applied appropriate economic analysis.
