We provide economic and financial expert testimony in regulatory and legal disputes involving pricing, royalties, cost recovery, terms of access, and contract performance.  We analyze the competitiveness of all oil and gas markets – exploration and production, midstream refining and processing, transportation and storage, and wholesale and end-use – in the context of antitrust disputes, mergers and acquisitions, and government inquiries. We quantify damages from breached or prematurely terminated contracts. We consult in matters involving oil and gas futures and derivatives, trading, and related accounting and valuation practices. We provide strategic advice to clients on service design and pricing, asset valuation, and risk management.

Our clients include natural gas and petroleum producers, pipeline and midstream companies, refiners, shippers, utilities, regulators, law firms, and governments in North and South America, Europe, Australia, and Asia. We have provided expert testimony on natural gas and petroleum matters in several forums, including international arbitration tribunals (including ICC, ICSID, ICDR, LCIA, and UNCITRAL); Federal and state courts in the U.S., Europe, and Australia; the U.S. Federal Energy Regulatory Commission (FERC); the National Energy Board of Canada; the UK Office of Gas and Electricity Markets; the Alberta Energy Resources Conservation Board; and U.S. state utility commissions.

Consistent with the economic and financial analysis provided by Brattle economists in the FERC's NOI on behalf of the United Airlines Petitioners and Aligned Shippers, FERC eliminated the income tax allowance for MLP pipelines noting that “an impermissible double recovery results from granting an MLP pipeline both an income tax allowance and a DCF ROE.”

Below is a list of representative engagements for our Natural Gas & Petroleum practice.

Natural gas and oil pipeline ratemaking

We have extensive experience in preparing as well as evaluating pipeline cost of service studies. In the context of rate proceedings, The Brattle Group has modeled the transportation rates of several natural gas and oil pipelines including El Paso Natural Gas, Tennessee Gas Pipeline, TransCanada Pipeline, Florida Gas Transmission, Iroquois Gas Transmission, SFPP, Enterprise Teppco, Buckeye, SoCalGas, Pacific Gas & Electric, British Gas and Gaz Metropolitain. We have testified in numerous proceedings regarding rate base derivation, appropriate operations and maintenance expense levels (including parent company overhead cost allocations), allowed return, test year billing determinants, and the appropriate treatment of discounts.  We have also analyzed and addressed cost allocation procedures in testimony, including allocation between non‑jurisdictional and jurisdictional activities, as well as amongst separate jurisdictional systems.  Our work often involves testifying as to the appropriate rate design methodology.

Dispute over breach of trading agreements

A buyer entered into an agreement to purchase a number of spot crude and refined product cargoes with a bank counterparty. The buyer alleged that its counterparty breached the trading agreement and entered into unauthorized and ineffective hedging transactions, resulting in significant losses. The Brattle Group worked with a former crude and products trader to evaluate whether the seller acted in accordance with standard crude oil trading practices, and whether the hedge transactions were effective. The report identified significant divergences from standard trading practices and demonstrated that the selected hedge instruments exposed the buyer to significant basis risks, which caused the buyer to incur significant economic losses when markets moved.

FERC natural gas market manipulation

On behalf of the Enforcement Litigation Staff of the Federal Energy Regulatory Commission, we investigated the activities of a natural gas trading company over a two-year period and determined that the company manipulated the price of natural gas at a specific location through its trading patterns on the Intercontinental Exchange (ICE) trading platform.  The results of our investigation were included in a report to the Federal Energy Regulatory Commission.
