On March 4, 2019 Judge Charles R. Breyer of the U.S. District Court for the Northern District of California acquitted Barclays FX options trader Robert Bogucki of allegations related to front running. Judge Breyer noted that “the government completely overreached” in its criminal prosecution of Mr. Bogucki. He noted several key factors in the decision: the over-the-counter FX options market is largely unregulated; pre-hedging of potential customer transactions is permitted; and ISDA Agreements explicitly designate trading counterparties as principals.

The panelists will discuss issues at the heart of the case, the research and analysis developed in defending Mr. Bogucki, as well as the prosecution’s approach to presenting the case. The panelists will also offer their take on Judge Breyer’s decision to acquit Mr. Bogucki and possible implications for future cases and for the FX market as a whole.
