Academic Advisor Michael Moore to Discuss Defeating Class Action Certification at Forthcoming Strafford CLE Webinar

Brattle academic advisor Michael Moore will participate in the upcoming Strafford CLE webinar, “Defeating Class Certification by Attacking Plaintiffs’ Classwide Damages Models,” taking place December 22, 2015 from 1:00-2:30pm EST.

Professor Moore’s panel will provide guidance for class action defense counsel seeking to defeat class certification by challenging the various damages models plaintiffs put forth in class litigation. The panel will also examine common damages models, how the courts have addressed them, and strategies for attacking them post-Comcast based on economic, statistical, or methodological flaws.

In addition to defense strategies for attacking damages models, Professor Moore will also discuss uses and abuses of multiple regression analysis in class certification litigation, focusing on two important issues: the standard set forth in Comcast v. Behrend as it relates to the “isolation” problem, and the “averaging” problem inherent in attempting a regression analysis to individualize outcomes.
