Brattle Experts Coauthor Article on Interest and Limitation Rules for Competition Damages Across Europe

Brattle Principal Lucrezio Figurelli and Associate Filippo Nezzo have coauthored “Competition damages in Europe: comparing national rules on interest and limitation,” which was recently published in the Journal of European Competition Law & Practice.
The article examines how national rules on interest and limitation periods affect competition damages awards across the 27 EU Member States, England and Wales, and Norway. The authors analyze two modeled follow-on damages scenarios, comparing how different jurisdictions treat compensatory interest, default interest, interest accrual periods, simple versus compound interest, and absolute limitation periods.
The authors find that partially harmonized EU rules still leave meaningful differences in how competition damages claims are valued across jurisdictions, creating an uneven playing field for litigants and potential incentives for forum shopping.
