Certain Solid State Storage Drives, Stacked Electronics Components, and Products Containing Same (Inv. 337-TA-1097)

During an investigation concerning solid-state drives, Dr. Seth led the Brattle team assisting counsel for complainant BiTMICRO by preparing an expert report analyzing the economic domestic industry. In a 100-day proceeding, Dr. Coleman Bazelon provided trial testimony. In this landmark decision, the ITC clarified that subsections (A) and (B) are not limited solely to manufacturing activities, and affirmed the administrative law judge’s (ALJ’s) initial determination (ID) that BiTMICRO had satisfied the economic prong of the domestic industry requirement for three of the four asserted patents.
