Dr. Wainscoat has two decades of experience advising private and government clients on competition, regulatory, and damages matters in Australia and New Zealand.
He has served as an economic expert before the Federal Court of Australia, the Supreme Court of Victoria, and the Fair Work Commission. He has prepared expert reports and provided testimony in matters involving competition issues and commercial damages, including those requiring detailed empirical and statistical analysis.
Dr. Wainscoat advises clients across the full range of competition issues, including merger clearance, market studies, authorization applications, cartel investigations, concerted practices, exclusive dealing, misuse of market power, and anticompetitive agreements. He has prepared expert reports and provided advice to the Australian Competition and Consumer Commission (ACCC) and private clients on the competitive effects of mergers, including under Australia’s new merger regime. His experience spans a wide range of industries including advertising, digital platforms, supermarkets and grocery, banking, insurance, pharmaceuticals, transportation, energy, telecommunications, rail, airports, and utilities.
He also advises clients and has provided expert testimony on commercial damages matters. These engagements have involved detailed empirical analyses to assess damages in disputes ranging from breach of contract and intellectual property claims to allegations of misleading and deceptive conduct. Dr. Wainscoat has additional experience managing regulatory projects, particularly in the energy, telecommunications, and rail sectors.
The section editor of the Australian Journal of Competition and Consumer Law, Dr. Wainscoat also lectures on competition and regulatory economics at the University of Sydney. Prior to joining Brattle, Dr. Wainscoat worked as an economist at consultancies in Sydney. He previously worked as an economist at the United Kingdom’s Office of Fair Trading (the predecessor to the Competition and Markets Authority).
