James Keyte Assesses the Proposed Draft Merger Guidelines in Antitrust Magazine

Director of Global Development James Keyte has authored an Antitrust Magazine article on the Draft Merger Guidelines (DMG) proposed by the US Department of Justice and the Federal Trade Commission to guide the agencies’ review of mergers and acquisitions to determine compliance with federal antitrust laws.
The article, “The Draft Merger Guidelines: Interpretive Guidance or Ideological Advocacy?,” assesses the proposed DMG against current case law and past vertical and horizontal merger guidelines. Mr. Keyte also discusses the agencies’ overall objectives and strategies with the DMG and how the guidelines are a transparent declaration of how they plan to take on Big Tech and other major platforms.
